Using KidCycle.

Please DO NOT:

  • violate any laws or our Prohibited Content Policy;
  • be false or misleading;
  • infringe any third-party right;
  • distribute or contain spam, chain letters, or pyramid schemes;
  • distribute viruses or any other technologies that may harm KidCycle or the interests or property of KidCycle users;
  • impose an unreasonable load on our infrastructure or interfere with the proper working of KidCycle;
  • copy, modify, or distribute any other person's content;
  • harvest or otherwise collect information about others, including email addresses, without their consent;
  • bypass measures used to prevent or restrict access to KidCycle.

Abusing KidCycle.

Please e-mail us to let us know about any problems or offensive content so that together we can keep the site working properly. We may limit or terminate our service, remove hosted content and take technical and legal steps to keep users off KidCycle if we feel it becomes necessary to do so. We do not accept any liability for monitoring KidCycle or for unauthorized or unlawful content on KidCycle or use of KidCycle by users.

Content.refers to contributions from us, you, and other users. You agree not to copy, modify, or distribute KidCycle, our copyrights or trademarks. When you give us content, you are granting us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise the copyright, publicity, and database rights to that content. (We need these rights in order to host and display your content.) We reserve the right to remove content where we have grounds for suspecting the violation of these terms or of any party's rights.

Liability. You agree not to hold us responsible for things other users post or do. As most of the information on KidCycle comes from other users, we do not guarantee the accuracy of postings or user communications or the quality, safety, or legality of what's offered. We also cannot guarantee continuous or secure access to our services. Accordingly, to the extent legally permitted we expressly disclaim all warranties, representations and conditions, express or implied, including those of quality, merchantability, merchantable quality, durability, fitness for a particular purpose and those arising by statute. We are not liable for any loss, whether of money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of KidCycle, even if you advise us or we could reasonably foresee the possibility of any such damage occurring.

Personal Information. By using KidCycle, you agree to the collection, transfer, storage and use of your personal information by KidCycle (the "data controller") on servers located in the United States and/or Canada as further described in our privacy policy.

General.

These terms and the other policies posted on KidCycle constitute the entire agreement between KidCycle and you, superseding any prior agreements. This agreement is governed by the laws of Canada. If we don't enforce any particular provision, we are not waiving our right to do so later. If a court strikes down any of these terms, the remaining terms will survive. We may automatically assign this agreement in our sole discretion in accordance with the notice provision below. Except for notices relating to illegal or infringing content, your notices to us must be sent by email to KidCycle. We will send notices to you via the email address that users provide. We may update this agreement at any time, with updates taking effect when you next post or after 30 days, whichever is sooner. KidCycle Policies

The following activities are prohibited from KidCycle Canada:

  • Posting an Ad if you are not located Canada
  • Posting an item for sale that is not located in Canada
  • Posting an item for sale that is illegal to own, buy or sell in your area of residence
  • Posting an item for sale that is in the prohibited items list
  • Posting an Ad that serves no other purpose than to send traffic to another web site
  • Posting an Ad that defames anyone or contains "hate speech"
  • Posting a multi-level marketing or other prohibited job

Any Ads or users that do not comply with the KidCycle Canada policy will be removed and blocked from the site.

Our general rule is that you may not list, buy or sell items or services that are illegal to own, buy or sell in your Province of residence, or that are not bought or sold in compliance with applicable laws and regulations.

IMPORTANT: YOU ARE RESPONSIBLE FOR ENSURING COMPLIANCE WITH ALL APPLICABLE LAWS RELATING TO THE ITEM YOU LIST, BUY OR SELL ON THIS SITE.

We specifically prohibit the following items:

  • Fireworks, Destructive Devices and Explosives
  • Recalled items
  • Stolen Property

Other Posting Policies:

Duplicate ads are not allowed. If you violate this policy you may receive a blocked message during the posting process or may be notified that your Ad has been removed from the site at a later time. To avoid this, please list whatever you are advertising only once. If you want to re-list an item that you are already advertising on the site, delete your existing Ad first.

You are not permitted to defame anyone or include "hate speech" directed at individuals or groups in your postings. KidCycle reserves the right to delete any Ads from the site that are deemed to negatively impact the community. If you encounter any such Ads, please contact us.

Kidcycle also reserves the right to ban your IP address at our own discretion, based on your compliance with our guidelines.



This privacy policy describes how we handle your personal information. We collect, use, and share personal information to help the KidCycle website ("KidCycle") work and to keep it safe (details below). In formal terms, KidCycle, acting itself and through its subsidiaries, is the "data controller" of your personal information. This policy is effective Jan 15, 2007.

Collection.

Information posted on KidCycle is obviously publicly available. Our servers are located in the United States and/or Canada. Therefore, if you choose to provide us with personal information, you are consenting to the transfer and storage of that information on our servers in the United States and/or Canada. We collect and store the following personal information:

  • email address, physical contact information, and (depending on the service used) sometimes financial information;
  • computer sign-on data, statistics on page views, traffic to and from KidCycle and ad data (all through cookies - you can take steps to disable the cookies on your browser although this is likely to affect your ability to use the site);
  • other information, including users IP address and standard web log information.

Use.

We use users' personal information to:

  • provide our services
  • resolve disputes, collect fees, (if applicable, KidCycle is FREE) and troubleshoot problems;
  • encourage safe trading and enforce our policies;
  • customize users' experience, measure interest in our services, and inform users about services and updates;
  • communicate marketing and promotional offers to you;
  • do other things for users as described when we collect the information.

Disclosure. We don't sell or rent users' personal information to third parties for their marketing purposes without users explicit consent. We may disclose personal information to respond to legal requirements, enforce our policies, respond to claims that a posting or other content violates other's rights, or protect anyone's rights, property, or safety. We may also share personal information with:

  • corporate affiliates who help detect and prevent potentially illegal acts and provide joint services. (Our corporate affiliates will market only to users who ask them to).
  • service providers who help with our business operations.

Using Information from KidCycle.

You may use personal information gathered from KidCycle only to follow up with another user about a specific posting, not to send spam or collect personal information from someone who hasn't agreed to that.

Access, Modification, and Deletion.

You can see, modify or erase your personal information by reviewing your posting or account status page. Contact us to review any personal information we store that is not available on KidCycle. We delete personal information when we no longer need it for the purposes we described earlier. We retain personal information as permitted by law to resolve disputes, enforce our policies; and prevent bad guys from coming back.

Security.

We use lots of tools (encryption, passwords, physical security) to protect your personal information against unauthorized access and disclosure, but as you probably know, nothing's perfect, so we make no guarantees.

General.

We may update this policy at any time, with updates taking effect when you next post or after 30 days, whichever is sooner. If we or our corporate affiliates are involved in a merger or acquisition, we may share personal information with another company, but this policy will continue to apply.
